Thur Oct 11 BP Close to Spill Settlement: Multibillion Dollar Deal with U.S. Would Combine Civil, Criminal Liabilities. By Daniel Gilbert p. A2

[Paraphrasing] The article states that the US government and BP are closer to reaching a settlement. The settlement is based on the presumption that 4.9 million barrels of crude entered the Gulf of Mexico. BP’s liability under the Clean Water Act could range between $5.4 billion and $21 billion in civil penalties. 

At issue is the degree of BP’s negligence. 

The Justice Department is considering whether to levy fines through a provision of the Oil Pollution Act known as the Natural Resource Damage Assessment.  

 However, any fines through this act could be used by BP to reduce its tax liability. 

Fines levied through the Oil Pollution Act must go to cleaning up the environment while fines levied through the Clean Water Act can also go to economic development. 

BP estimates that the total cost of the accident will not exceed $37.2 billion.

Now oil in the Gulf has been fingerprinted as deriving from the Macondo well, over two years after the well was purportedly capped.

I believe that Tepco is following the BP oil script.

I believe there were two major blow-out sites with BP and one was huge (Simmons describes it as a "open hole" about 10 miles away), while the other (riser leak) was much smaller. We saw the small blow-out site on the cam.

The radiation readings in the US are rising alarmingly in many areas. Yet, we see relatively few emissions (compared to what we've seen over the last 19 months) from the Tepco webcam.

Is the source of ongoing and elevating radiation levels in the US and Japan some off-camera Fukushima Daiichi spent fuel pool, or has some other nuclear plant melted down as well?
