Emergency Powers and Slippery Slopes



The Italian social philosopher Giorgio Agamben points out that sovereignty in the modern era is most aptly dramatized by the power of decision that emerges under conditions of crisis.[i]

He describes sovereignty as arising from the decision to deny individuals full recognition of their rights, a kind of exclusion smuggled into democratic government.

There is little doubt that rights foundational to liberal democratic government, and encoded constitutionally, can be sacrificed during times of crisis. Indeed, many if not most governments in the world have exceptions built into their constitutions that afford executives inordinate emergency decision-making power.

For example, fifty-three states of emergency have been declared by US presidents since 1976 when the US passed the National Emergencies Act and the majority of these declarations remain in effect.[ii]

As of 2014, President Barack Obama had declared nine emergencies, allowed one to expire and extended 22 emergencies enacted by his predecessors.”[iii]

These Executive Orders afford the president’s office special powers, including the capacities to declare martial law, seize property, call up the National Guard, censor sensitive information, and fire military officers, among other discretionary powers.

TRUMP INVOKES EMERGENCY POWER

President Trump has demonstrated disregard for procedures and legal frameworks, seeking to impose his will arbitrarily as illustrated today:

“Do you believe that the president does have the authority to block private businesses from investing in China?” CBS News' Margaret Brennan asked Kudlow on “Face the Nation” Sunday.

“Ultimately, he does have authority,” responded Kudlow. “It’s an emergency economic power authority,” he said, adding that Trump “is not intending to” block trade with China at this time.

Amid an escalating trade war, Trump in a series of angry tweets Friday “ordered” American companies “to immediately start looking for an alternative to China, including bringing our companies HOME and making your products in the USA.”
Fascism is the slippery slope upon which democracy founders. This has long been acknowledged given the rise of authoritarianism within liberal democracies over the 20th century. Now the US is sliding downward....



China and Russia may be economic adversaries for the US but they are also partners in our collective salvation as we all face ruined eco-systems and limited vital resources.

" I regard this as an opinion of one who is no fan of the President and not a technical analysis. If your analysis were true there would immediately be a flock of disturbed individuals running to Federal Judges to get injunctions which happens all the time as you know quite well.

    But it allows you to write the following: "Fascism is the slippery slope upon which democracy founders. This has long been acknowledged given the rise of authoritarianism within liberal democracies over the 20th century. Now the US is sliding downward . . ." Isn't that scare mongering?

    Who is now pushing Socialism? Not Trump. I have an aversion to coercion, and socialism entails a lot of coercion. Whether Socialism or Communism we arrive at that same destination.

    Russia and China are very different places. I could live in Russia but not China. What about yourself?

    In my opinion it is time to leave fascism for the European who after all invented it. Let the EU play that one out without the UK and the US and let China move toward a republic--I won't say democracy as it is too often mob rule. For some reason even very smart people over estimate democracy. For example, Professor Amar at Yale who wants the president to be elected by popular vote. Whereas I think electing Senators after the 17 Amendment has been a failure. If you get sick do you want people to vote on the diagnosis or remedy? Are you sensitive to St. Augustine's dictum, "The Voice of the People is the Voice of God"?

      During the six year period a total of 315 women (3.5%) developed breast cancer.

      After adjusting for other risk factors that contribute to breast cancer, such as age and obesity, the investigators found that the risk for women with the highest bone density for all three skeletal sites was 2.7 times greater than that for women with the lowest measurement of bone density for all three sites."

      "The results suggest that bone mineral density is one of the most powerful predictors of breast cancer, especially advanced breast cancer, among elderly women," Dr Cauley said.




      There is a direct mechanism of action of increased bone density and an increase of serum levels of radionuclides bioccumulated in bone matrix being released in a steady-state into the blood and plasma.
      The link of high bone density and breast cancer is truly related to Radionuclide tocicokinetics and depositions.
      Everyone in the world has some Stroontium 90 Uranium substrates in their bones now.
      People in the developed nuclear counntries, have the highest concentrations in their bodies.
      Bone matrix is a primary storing site for the certain radionuclides in the body.
      Bioccumulated radionuclides mimic calcium and phosphorus .

  6. Three well known American presidents have at one time or anther spoken well of Fascism. FDR expressed admiration for Hitler and Mussolini. He later switched his affections to Stalin and Communism. JFK thought Hitler would some day be seen in a better light. Bill Clinton was a fan of Mussolini. How to interpret this is unclear to me except that Fascism is not abhorred by the Elite. And really unless one is intellectually blind Communism is like a different flavor of despotism.

    Fascism has become a buzz word as has Nazi.
